Mr. Charles A Mollis received his Juris Doctor at Western State University.  He is active in the local legal community.  His professional honors include receiving the “American Jurisprudence Award” in Corporations. In addition, Mr. Mollis has had two published cases. The first case, Nanfito v. Superior Court (1991), 2 Cal. App. 4th 315: 2 C.R. 2nd 876, Mr. Mollis represented the defendant who had presented a motion to dismiss after plaintiff had elected arbitration just prior to running of the five-year statute. The court refused to hear defendant’s motion and ruled that, with plaintiff’s arbitration election, it stripped the court of jurisdiction to rule. The Appeals Court reversed the trial court in defendant’s favor and ordered the lower court to hear the motion and that it had retained jurisdiction and should have refused plaintiff’s election so close to the running of the statute of limitations. The second case J.C. Gury Company v. Nippon Carbide Industries (USA) Inc., (2007) 152 Cal. App. 4th 1300, Mr. Mollis represented the plaintiff that had won an arbitration award, which had been upheld by the trial court. Defendant appealed stating that the arbitrator had exceeded his authority when he found contract provisions unconscionable. Both parties had submitted on the issue of unconscionability to arbitration. The Appeals Court, in favor of the plaintiff, ruled that defendant had submitted on the issue and he could not argue that an adverse decision exceeded the arbitrator’s authority.
